What are asbestos re-inspections?
Regulation 4 (Duty to Manage) of the Control of Asbestos Regulations 2012 requires non domestic building owners or Dutyholders to firstly establish if their building contains asbestos and ,if so, effectively manage it.
As a part of this management process asbestos re-inspection surveys are undertaken on a regular basis to establish that any asbestos previously identified has not been damaged or has deteriorated to an extent whereby it has become hazardous.
When an asbestos-containing material’s condition changes, the associated risks (material risk) with the product can change substantially and may no longer be safe and manageable.
Essentially, regularly carrying out a re-inspection survey means you meet your obligations under UK asbestos law.
Is an asbestos re-inspection a legal requirement?
If you are responsible for a property that has been inspected for asbestos, then you are obligated under The Control of Asbestos Regulations (CAR) 2012 to make sure that an annual re-inspection is carried out.
It is not a legal requirement to have an asbestos re-inspection. However, it is a legal requirement to “manage asbestos” in all non-domestic premises. This is detailed under Regulation 4, Duty to manage asbestos in non-domestic premises – Control of Asbestos Regulation 2012.
The Approved Code of Practice for The Control of Asbestos Regulations 2012 states:
“As a minimum, the management plan, including records and drawings, should be reviewed every 12 months.”
Therefore, an asbestos re-inspection should be undertaken annually as an absolute minimum.
